PNW SITE SERVICES / LEGAL INFORMATION
Effective date
Effective November 1, 2026 · Version V1.0.2. These Terms govern the website, communications, quotations and rental orders of PNW Site Services, Inc. (Company). Transaction-specific terms require valid affirmative acceptance. Document priority: a mutually executed amendment; accepted Rental Agreement; confirmed order and disclosed fee schedule; then these Terms. Later revisions do not retroactively alter accepted transactions without lawful agreement.
Website and service information
Website information and preliminary quotes are nonbinding and may be changed or withdrawn before Company accepts an order. Availability, rates, container size, included days and weight, disposal conditions and scheduling must be confirmed. Company may decline requests for legitimate commercial, operational, safety or legal reasons. Once an order is accepted, Company may adjust charges under agreed formulas (including excess weight, extended time, additional hauls, material misclassification and disclosed fees), or propose revised terms for customer acceptance; Company will not unilaterally impose an undisclosed increase to an accepted fixed price.
Customer responsibilities
Customer warrants authority to order and authorize container placement, must obtain required permissions and permits, disclose site hazards, maintain safe truck and container access, prevent overloads, and follow accepted materials restrictions. Customer is responsible for documented, contractually authorized charges for extra days, overweight loads, contamination, prohibited materials, damage caused by Customer, blocked access and failed trips. Company may refuse unsafe or unlawful service. Customer must not relocate or modify Company equipment.
SMS Messaging Terms
PNW Site Services, Inc. offers optional service-related SMS for inquiries, quotes, reservations, scheduling, delivery and pickup, billing and support. Website opt-in requires selecting Text Message as the preferred contact method AND affirmatively checking the separate SMS consent checkbox; selecting a contact preference alone is not consent. Customers may also provide verbal consent after an appropriate disclosure. The first Company-initiated outbound SMS to an opted-in customer will include: "Reply STOP to opt out." Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not required to purchase. Carriers are not liable for delayed or undelivered messages. Privacy Policy: https://pnwsiteservices.com/privacy-policy.
SMS consent and opt-out
Customers may withdraw SMS consent by replying STOP. We may send a final opt-out confirmation as permitted. Reply HELP for assistance or visit https://pnwsiteservices.com/contact. A first-message opt-out instruction does not replace consent at enrollment. Any future marketing SMS program will obtain separately required consent.
Privacy and mobile data
Our Privacy Policy explains data processing, including automated or AI-assisted systems. Mobile numbers, SMS opt-in records and consent will not be sold or shared with third parties or affiliates for their independent marketing. Authorized communications providers may process data to provide our services.
Acceptable use and intellectual property
You agree not to misuse the website, interfere with its operation, submit unlawful content, or attempt unauthorized access. Website text, graphics, branding, and design are protected by applicable intellectual property laws.
Disclaimers and liability
By affirmatively accepting an order and payment authorization, Customer authorizes Company and authorized processors to securely store payment credentials and charge any payment method previously supplied and authorized for account-level rental billing for amounts due under the accepted order or Rental Agreement, including disclosed additional days, weight overages, special handling, failed trips, equipment damage and unpaid balances, without separate approval for each eligible charge, subject to law and card-network rules. Providing a card alone is not blanket authorization for all cards or unrelated charges. Company may use Stripe, Square, or other processors added or substituted without individual advance notice where lawful; processors may securely store credentials. Customer is never required to disclose card details directly to Company personnel and may always request a secure payment link. If card information is voluntarily provided by phone, authorized staff may temporarily record it for processing and will seek to securely dispose of temporary records afterward under applicable requirements; card verification codes are not retained after authorization. Company may cancel, suspend, reschedule or terminate service for legitimate operational, commercial, safety, regulatory or payment reasons, subject to nonwaivable duties and required refunds. To the extent enforceable, Company disclaims liability for indirect or consequential losses such as project delays, standby labor, substitute services and lost profits. Lawful claims and payment disputes remain available. Courts retain jurisdiction unless parties separately validly agree to arbitration; Company cannot impose arbitration unilaterally after a dispute.
Changes and contact
Company may revise these Terms prospectively by posting a new effective date and version. Invalid provisions are severable; non-enforcement is not waiver. Contact info@pnwsiteservices.com, (253) 499-8840, or https://pnwsiteservices.com/contact. Effective November 1, 2026 · Version V1.0.2.
