PNW SITE SERVICES / RENTAL TERMS
Effective date
Effective November 1, 2026 · Version V1.2.3 · Revised November 2, 2026. This Rental Agreement governs dumpster rentals provided by PNW Site Services, Inc. The accepted order identifies rental price, included days, weight allowance, permitted materials and disclosed variable charges. Revisions apply to transactions validly accepted under this version, not retroactively to earlier agreements without lawful consent.
1. Agreement and rental order
This Agreement governs dumpster rentals supplied by PNW Site Services, Inc. (Company). The accepted quote or invoice identifies the customer, service location, container, included rental days, included weight, permitted materials, and applicable prices. Specific written order terms prevail over general terms here. Company may use independent carriers and disposal facilities. The actual contracting entity must be accurately named on the order.
2. Pricing and payment
The accepted order controls initial pricing, extension rates, included weight, overage rates and disclosed cancellation or trip charges. Unaccepted quotes may be revised or withdrawn; accepted fixed pricing is adjusted only under agreed variable-charge formulas or subsequent agreement. Payment is required before dispatch unless otherwise agreed. By affirmatively accepting this Agreement and a clearly disclosed payment authorization, Customer authorizes Company and its processors to securely retain authorized payment credentials and charge any previously supplied payment method authorized for account-level rental billing for contractually owed extra days, overweight disposal, additional hauls, special handling, failed trips, customer-caused damage and unpaid balances without new approval for each eligible charge, subject to law and card-network rules. Providing a card alone does not authorize all cards or unrelated charges. Payment providers may include Stripe, Square and additional or replacement processors without individual advance notice where lawful. Customer is never required to provide card information directly to Company personnel and may always request a secure payment link. If Customer voluntarily provides card details by phone, staff may temporarily record or handle them to process payment, then seek to securely dispose of temporary records under applicable requirements. Card security codes are not retained after authorization. Company provides itemized charges and reviews good-faith disputes.
3. Rental period and pickup
Included rental days are counted as stated on the order. Unless Company expressly confirms an automatic pickup, Customer must request collection when finished. Pickup requests are subject to routing, disposal facility hours, weather, and safe access. Extension charges may accrue after included time ends, except for delay caused by Company. Unused included time is not automatically refundable.
4. Pickup Requests, Rental Extensions, and Charge Cutoffs
Unless automatic collection is expressly included in the accepted order, Customer must request pickup when the container is ready for removal. Requests may be sent to dispatch@pnwsiteservices.com or made by calling or texting (253) 499-8840; a request becomes effective when received through a designated channel. Customer must ensure safe loading, unobstructed access, and readiness for collection. Extension charges accrue according to the accepted order until the included rental period ends or a qualifying pickup request becomes effective, whichever is later. When a timely request is received and the container is ready for safe removal, extension charges will not continue solely because Company schedules collection later. If collection is prevented by blocked access, unsafe loading, excessive weight, prohibited materials, or other Customer-controlled circumstances, previously disclosed lawful extension or unsuccessful-trip charges may apply until the condition is corrected and Company is notified. Routing, weather, facility hours, and other operational conditions affect scheduling; pickup times are estimates unless expressly guaranteed.
5. Materials and disposal rules
Load only materials approved for the specific order and disposal facility. Hazardous waste, liquids, fuels, chemicals, batteries, pressurized cylinders, medical waste, asbestos-containing materials, and contaminated materials are prohibited unless Company has explicitly approved a lawful specialized service. Tires, mattresses, appliances, electronics, treated wood, roofing debris, concrete, dirt, and other special materials may be restricted or priced separately by region. Ask before loading uncertain materials.
6. Prohibited Materials, Contamination, and Additional Disposal Costs
Customer is responsible for ensuring materials comply with the accepted order, applicable laws, and receiving-facility requirements. If a load contains prohibited, hazardous, contaminated, misclassified, or otherwise nonconforming materials, Company may refuse collection, suspend service, arrange lawful alternative handling, or require Customer to correct the condition. To the extent caused by Customer or persons under Customer's control, Customer shall reimburse reasonable, documented additional costs including facility rejection charges, special handling, transportation, sorting, lawful disposal, cleaning, remediation, and regulatory charges or penalties where recoverable by law. Company will notify Customer when reasonably practicable before material discretionary expenses, except where immediate action is reasonably necessary for safety, environmental protection, or legal compliance. Company shall not knowingly dispose of prohibited materials unlawfully.
7. Asbestos-Containing Materials, Testing, and Documentation
Customer shall not place asbestos-containing materials (ACM), suspected ACM, or asbestos-contaminated debris in a container without Company's express prior written authorization and compliance with all applicable asbestos handling, transportation, and disposal requirements. OREGON: Before demolition or renovation, an asbestos survey by an accredited inspector is generally required for all commercial buildings regardless of construction date and for residential buildings constructed before January 1, 2004. A qualifying owner-occupant performing their own renovation of a single-family residence may be exempt from the survey requirement; this exemption does not apply to demolition. Where allowed by Oregon rules, materials may instead be presumed to contain asbestos and managed through appropriately licensed abatement. Required survey reports must be maintained at the worksite and provided to regulators upon request. WASHINGTON: Before construction, renovation, remodeling, maintenance, repair, or demolition work that may disturb asbestos-containing materials, the owner or owner's agent must arrange a documented good-faith inspection by an accredited asbestos inspector, regardless of building age, unless a lawful exception applies, including reasonable certainty that asbestos will not be disturbed or treating suspect materials as asbestos under applicable rules. Qualifying owner-occupants performing work themselves in their own noncommercial residence may be exempt from general survey requirements; required information must nevertheless be shared with contractors and workers. Required written inspection findings, assumption statements, and other notices must be provided or posted as applicable. CUSTOMER DOCUMENTATION: Customer shall obtain and retain all legally required surveys, inspection reports, laboratory results, notifications, abatement records, and disposal approvals, and provide copies to Company on request before delivery or pickup. Company may require additional reasonable documentation as a condition of service or as required by the receiving facility, including where a regulatory survey exemption applies. Customer shall disclose known or suspected asbestos and shall not describe suspect materials as asbestos-free without a legally sufficient basis. Company may refuse, suspend, or reject service pending satisfactory documentation, safe removal, and lawful disposal arrangements. If prohibited asbestos materials are discovered after collection, Customer remains responsible, to the extent caused by Customer or persons for whom Customer is legally responsible, for reasonable documented testing, containment, handling, rejected-load, transportation, disposal, cleaning, remediation, and legally recoverable regulatory costs. Company has no obligation to transport or dispose of asbestos without required authorizations and arrangements. Nothing shifts nonwaivable statutory duties or excuses Company or its haulers from their own negligence or legal obligations.
8. Weight and safe loading
The accepted order states the included weight and per-unit overage rate. Facility scale tickets or other reliable records establish billable weight; supporting records are available on request when obtainable. Do not load above the rim or block the doors or tarping system. Distribute heavy debris safely. Company may refuse an overweight, overfilled, or unsafe load until corrected. Customer bears reasonably documented incremental costs caused by prohibited or misclassified customer-supplied contents, subject to law.
9. Heavy Materials, Loading Limits, and Container Safety
Customer shall load only approved materials and comply with the accepted order's weight, volume, fill-height, and material restrictions. No material may extend above the rim or prevent safe tarping, lifting, transport, or unloading. Maximum permitted waste payload for a tandem-axle roll-off truck is 20,000 pounds (10 tons); for smaller single-axle roll-off trucks commonly serving 10-, 15-, and 20-yard containers it is 8,000 pounds (4 tons). These are upper limits, not guaranteed allowable weights; actual legal capacity may be lower due to assigned truck, container tare weight, axle ratings, road limits, or site conditions. Customer must comply with any lower communicated limit. Concrete, asphalt, dirt, soil, gravel, rock, brick, masonry, and similar dense aggregate materials should be placed in a Company-approved 10-yard source-separated container. Where Company expressly allows mixing with other debris, no more than 1 cubic yard of such materials may be mixed in 10-, 15-, or 20-yard containers, and no more than 3 cubic yards in 30- or 40-yard containers, subject always to stricter weight or material limits. For estimation, such materials may weigh approximately 2,000 pounds per cubic yard, but actual weights can be substantially higher depending on material and moisture; Customer owes actual weight overages not included in the accepted order. A container is severely overloaded when 23,000 pounds or more of material has been placed inside it, regardless of container size or truck configuration. Where severe overloading results from Customer's loading practices or those of persons under Customer's control, Company may assess a $500.00 Severe Overload Negligence Fee, which is reasonably supportable as compensation for additional safety risk, handling, administrative, or operational burdens rather than an unlawful penalty. The fee is subject to applicable law, advance disclosure and acceptance where required, and may be assessed alongside separately authorized documented excess-weight, transportation, or unsuccessful-trip charges without duplicate recovery. Company may refuse, postpone, or discontinue collection when personnel reasonably suspect an unsafe or unlawfully heavy load; Company need not attempt an unsafe lift, haul, or weighing. Customer must remove, redistribute, or otherwise correct the load at Customer's expense. Any additional collection attempt or service charge is subject to the accepted terms and law. Rear doors must be securely closed and latched before collection unless Company agrees otherwise; Company may refuse an unsafe load.
10. Delivery and collection access
Customer must keep access routes, gates, and the area around and in front of the dumpster clear of vehicles and obstacles. The surface must be reasonably level and support the truck and loaded container. Notify Company of low wires, soft ground, underground structures, or other hazards. A blocked or unsafe container may not be collected until corrected. A return trip caused by customer-controlled conditions may be charged only at the previously disclosed rate.
11. Site Conditions and Placement Risks
Customer represents that the designated delivery and collection location is accessible, lawful, and reasonably suitable for heavy commercial vehicles and loaded containers. Customer shall identify known underground utilities, septic systems, drainage structures, buried tanks, irrigation systems, fragile pavement, restricted clearances, overhead obstructions, and concealed or unusual hazards before delivery. Customer authorizes Company to enter the designated service area for delivery, inspection, servicing, and collection, subject to applicable law and reasonable safety requirements. Company will exercise reasonable care. To the extent permitted by law, Customer is responsible for damage arising from inaccurate site information, known but undisclosed hazards, unsuitable surfaces selected by Customer, or placement instructions contrary to Company's reasonable recommendations. Nothing excludes Company's responsibility for its own negligence or other nonwaivable liability.
12. Scheduling, cancellations, and unsuccessful trips
Customer must promptly notify Company of changes. Cancellation, dispatch, waiting and unsuccessful-trip fees apply only when disclosed before booking and lawful. Company may cancel, suspend, reschedule or terminate services for legitimate operational, commercial, safety, regulatory, availability or payment reasons, subject to applicable law, nonwaivable obligations and refunds required for prepaid services not performed. Delivery and pickup times are estimates unless expressly guaranteed. Company is not liable for indirect or consequential costs of permitted service changes, including customer project delays, standby labor or substitute services, to the extent legally enforceable. No provision excuses legally nonwaivable liability.
13. Container availability, substitutions, and service boundaries
Container sizes and requested service times are subject to actual equipment, driver, and facility availability. If the requested container becomes unavailable, Company may offer a different size, revised date, or cancellation with a refund of prepaid services not performed; Company will not substitute a differently priced container or impose new charges without Customer’s agreement. Service beyond the quoted location or geographic area requires a revised quote accepted before dispatch.
14. Customer Loading and Third-Party Use
Customer is responsible, to the extent provided by law, for the conduct of employees, contractors, occupants, invitees, and others whom Customer authorizes or permits to use the container. Customer shall not permit anyone to enter, climb on, mechanically lift, relocate, or operate the container unsafely. Loading must not create falling-debris hazards, obstruct doors or safety equipment, exceed applicable weight limits, or prevent safe transportation. Company may decline collection until unsafe conditions are corrected. Customer is responsible for reasonable, documented costs arising from Customer-controlled unsafe loading or misuse, excluding costs caused by Company or its contractors.
15. Unauthorized Dumping, Weather Exposure, and Disposal Weight
Customer shall exercise reasonable care to prevent unauthorized use while the container is at the service location and promptly report known unauthorized dumping or prohibited materials. Customer is responsible, to the extent permitted by law and the accepted terms, for material deposited by Customer, its contractors, invitees, or others whose use is within Customer's reasonable control. Disposal charges are based on actual measured weight, including moisture absorbed through ordinary weather exposure. Rain, snow, and other conditions may affect disposal weight; Company does not guarantee that material weight remains unchanged. Customer is not responsible for charges resulting from Company's negligence, improper equipment maintenance, or circumstances for which Customer is not legally responsible. Available weight documentation will be provided on reasonable request.
16. Container Ownership, Custody, and Damage
All rental containers and associated equipment remain the property of Company or its designated equipment owner. Customer receives only temporary permission to use the equipment for the agreed rental. Customer shall not sell, transfer, relocate, modify, sublease, conceal, or permit unauthorized removal of equipment. While equipment is at the service location, Customer shall exercise reasonable care and promptly notify Company of theft, vandalism, fire, collision, loss, or damage. To the extent caused by Customer's negligence, misuse, breach of this Agreement, or persons under Customer's control, Customer is responsible for reasonable, documented repair, recovery, or replacement costs, less applicable salvage value and excluding ordinary wear and tear. Customer is not responsible for loss or damage caused by Company, its contractors, or circumstances for which Customer is not legally responsible.
17. Property and equipment care
Heavy vehicles and containers may mark driveways, paving, lawns, or landscaping. Customer should identify fragile surfaces and arrange protective measures. Company will use reasonable care and remains responsible for its negligence. Customer must not move, modify, burn materials in, or sublease the dumpster. Customer is responsible for documented damage beyond normal wear caused by Customer or those under Customer’s control.
18. Authorization and permits
Customer confirms authority to arrange placement at the site and must obtain property owner permission, street-use permits, parking approval, and other required authorizations. The driver may reject or adjust a placement that is unsafe or unlawful.
19. Contracting Customer and Authorized Representatives
The person or legal entity identified as Customer in the accepted rental order is responsible for payment and performance. An individual accepting on behalf of an entity represents that they are authorized to bind that entity. A property owner, tenant, contractor, site representative, or cardholder does not become personally liable solely by owning the property, providing instructions, accepting delivery, or providing an authorized payment method. Personal guarantees or joint liability require a separate enforceable undertaking or applicable law. Company may rely on routine instructions from Customer's designated representative; material changes to scope, price, or obligations require approval by Customer or an authorized decision-maker. Customer shall promptly update authorized contacts.
20. Customer contacts, site representatives, and instructions
Customer must provide accurate site address, access instructions, a reachable contact, and notice of material changes before dispatch. Customer authorizes the designated site representative identified on the order to provide routine placement, access, and pickup instructions, but changes that increase price or materially change the agreed service require Customer’s approval. Company may rely on reasonable instructions from the authorized contact and may document service conditions with photographs. Customer should promptly correct inaccurate instructions that could cause delays, damage, or unsuccessful trips.
21. Post-Collection Charges and Final Billing
Collection or removal of the container does not constitute final settlement. Charges authorized by the accepted rental order or this Agreement may be assessed after collection when relevant information becomes available, including excess disposal weight, special materials, prohibited-material handling, additional transportation, equipment damage, and authorized unsuccessful-trip fees. Company may rely on scale tickets, facility invoices, photographs, inspection records, and other reasonably reliable documentation. Company will provide itemized charges and review good-faith disputes. Charging a stored payment method requires Customer's affirmative payment authorization and compliance with applicable law and card-network rules. Final billing may occur after collection when facilities or service providers report charges later.
22. Payment Default and Collection
Invoices are payable according to the accepted order or invoice terms. Customer shall promptly notify Company of a good-faith billing dispute and identify the amount and reason. Company may suspend additional services for unpaid undisputed balances after any legally required notice. Customer remains responsible for valid charges under the accepted Agreement. Late charges, interest, returned-payment charges, or collection fees apply only if separately disclosed where required and permitted by law. In an action to enforce this Agreement, the prevailing party may recover reasonable attorney fees and recoverable costs to the extent authorized by this Agreement and applicable law.
23. Rejected loads and site restoration
If a facility refuses a load, Company will contact Customer when reasonably practical to arrange lawful removal, separation, or alternative disposal. Company will not knowingly dispose of waste unlawfully or return debris onto the site without lawful authorization. Customer may be responsible for documented additional costs caused by contents that violate the agreed waste stream.
24. Waste Ownership, Transfer of Title, and Continuing Customer Responsibility
Upon collection and removal from the service location, title to waste accepted for transportation and disposal transfers to PNW Site Services, Inc. or, where an authorized third-party hauler performs the service, to that hauler as designated by Company and to the extent the hauler has agreed and applicable law permits. Transfer of title does not constitute acceptance of prohibited, hazardous, contaminated, misrepresented, or otherwise nonconforming materials, whether discovered before pickup, during transportation, at a facility, or after emptying. Customer remains responsible for compliance with the accepted order, disclosed restrictions, facility rules, and applicable law. If nonconforming materials are discovered after collection, Customer remains liable to the extent caused by Customer or persons for whom Customer is legally responsible for reasonable documented sorting, special handling, transportation, rejected-load, lawful disposal, cleaning, remediation, and recoverable regulatory costs. Company may invoice such charges after collection or charge an authorized payment method, subject to the accepted payment authorization and applicable law, and will provide an itemized explanation and available supporting records. Transfer of title does not release Customer from these obligations or override statutory environmental responsibility or Company's or a hauler's nonwaivable duties.
25. Equipment Recovery and Continued Access
Upon expiration or termination of the rental, Company may arrange collection during reasonable service hours, subject to lawful access and safety requirements. Customer shall cooperate in making equipment accessible and shall not intentionally obstruct, conceal, relocate, or withhold Company equipment. If collection is prevented by circumstances within Customer's control, Company may assess previously disclosed and lawful additional rental, waiting, or unsuccessful-trip charges and recover reasonable, documented costs directly caused by the obstruction. Company may pursue lawful remedies for equipment recovery. Nothing authorizes trespass, forced entry, breach of the peace, or unlawful self-help repossession. Termination does not extinguish accrued payment obligations.
26. Weather, emergencies, and service interruptions
Company may suspend, postpone, or decline delivery or collection when weather, wildfire smoke, flooding, road restrictions, public emergencies, disposal facility shutdowns, or other conditions make service unsafe, unlawful, or impracticable. Company will make reasonable efforts to notify Customer and resume service when feasible. Customer will not be charged extension fees solely for delays caused by Company’s inability to collect an otherwise accessible, compliant container. Any additional work or changed service price requires disclosure and Customer approval where applicable.
27. Liability and disputes
Each party remains responsible for negligence, misconduct and breach to the extent required by law. To the extent permitted by law, Customer indemnifies Company against third-party claims caused by Customer's unauthorized materials, negligent loading or improper site instructions, excluding Company-caused harm. Neither party is liable for indirect, special or consequential losses to the extent a lawful exclusion applies; statutory rights and remedies remain intact. The law applicable to the service location governs mandatory protections. Parties may pursue claims in a court of competent jurisdiction unless they have separately and validly agreed to arbitration. Company may propose arbitration but cannot require it unilaterally after a dispute arises. Customers may not impose unauthorized offsets or charges without a valid contractual or legal basis; lawful payment disputes and claims remain available.
28. Communications, records, and acceptance
Customer accepts this Agreement through affirmative acceptance before booking, not merely by browsing. Company may use contact information for lawful operational notices and may retain delivery photos, access records, scale tickets and service communications consistent with the Privacy Policy. SMS is optional: website consent requires selecting Text Message and checking the separate SMS checkbox; verbal consent may be obtained after disclosure. The first Company-initiated SMS to an opted-in customer will include "Reply STOP to opt out." Reply STOP to unsubscribe or HELP for assistance. Consent is not required for purchase. Preserve the accepted agreement version and payment authorization with each reservation.
